There are a lot of things you have to consider in processing H1B visa that could get a skilled worker to work in your company. Since some employers are not that familiar with the process, they go for the hiring of an H1Blawyer to help them with the process. From the confusion and questions, documentations to be prepared, constant monitoring and communicating with DOL until the approval of H1B visa. But some would rather do it by themselves. Then for those kinds of employers, they have to be equipped with all the necessary documents and requirements that are to be prepared. They have to know that the employer should have graduated a four- year course and should have experience with the occupation that is being given. The employer should be keen to know all the documents and papers for submission in DOL.

H1b VisaEverything has its limit and even with H1B visa, there are stated limits with the application. Every year, there are only for about 65,000 visas being issued and it issued for at most 6 years only. It is also going to be so hard for the H1B visa employer to easily change jobs unlike for those who are US citizens. There are instances that the employer has to change employer for some point and for this they have to undergo the process of H1B transfer. But there are really rules they have to follow in the process the transfer for if they won’t be able to meet the requirements and set dates, they will have to back to where they come from.

You might want to know what the advantages of the H1B visa employee are. There are actually a lot of benefits that an H1B visa holder could achieve. Aside of the chance of working in a foreign place and get a salary better than they used to have, they could stay in US for the maximum of 6 years. Another good thing is, they could bring their spouse or children below 21 years of age and let them stay in US until the time of their authorized stay. Since the families with age below 21 were issued an H-4 visa, they can’t work in US but they could study in US. With those kinds of benefit and experiences that they could achieve, they would go back to their country with a successful future ahead of them.

Application of H1B visa follows a certain process with some requirements. Most of the work will be the employer’s job in getting the approval of the H1B visa. First thing they have to do is make sure that they will file a Wage Determination Form with DOL to make sure that they are covering the fee for the “prevailing wage” the employee’s job. Then, they will file the LCA or the Labor Condition Application again with DOL and lastly, they have to secure form I-129 with USCIS. After everything is all cleared, they have to patiently wait for 2-5 months for the approval to be issued. Sometimes with this job, they hire an H1B lawyer and usually the lawyer would communicate with DOL and USCIS regarding the status of the processed application.
